Indictment Charges: Conspiracy to Distribute xxxx Kilograms or More of xxxxxxxxxxx
Mandatory Minimum: 20 years in federal prison.
Case Result: Rule 35 Granted & Sentence Reduction of 4.3 years. Attorney Tim Bower Rodriguez and his private investigator – a retired Miami-Dade narcotics detective – worked together to represent our client in his or her efforts to obtain a Rule 35 sentence reduction after our client had already been sent to federal prison. The client, who will remain nameless for his or her protection, testified at a federal trial as a government witness. The government requested a sentence reduction of only two-levels. Attorney Tim Bower Rodriguez requested a 6-level sentence reduction. The Court granted the government’s rule 35 motion for two-levels and added another level based upon the argument made by attorney Tim Bower Rodriguez. Below are the redacted court documents proving that Tim Bower Rodriguez was able to obtain a 3-level rule 35-sentence reduction. Meanwhile, we fully expect to obtain a second rule 35-sentence reduction for our client in the near future.
