Federal Direct Appeals

Federal direct appeals are pursued after a conviction at the United States District Court level, commonly referred to as the trial court level. A notice of appeal is filed and the case is sent to one of several United States Circuit Courts of Appeals. For example, an appeal from the Middle or Southern District of Florida is heard by the 11th Circuit Court of Appeals based in Atlanta, Georgia, while an appeal from the District Court of Puerto Rico is decided by the 1st Circuit Court of Appeals based in Boston, Massachusetts. Direct appeals can be filed on a wide variety of grounds, including the discovery of new evidence, insufficient evidence during the original trial, or procedural problems with the conduct of an arrest or trial. Attorney Tim Bower Rodriguez has successfully pursued a direct appeals based upon a wide variety of factual and legal issues and in various appellate courts.

Two additional specific types of appeal and post-conviction relief include Federal 2255 and 2254 procedures.
